THE LIVING DEAD – VICTIMS OF MRC AUDITS, PART 2

The Executive Committee of COFP has recently learned of some disturbing new facts concerning the MRC process.

To appeal or not to appeal? That is the question:

 

This answer is simple. You can’t appeal in a court of law, because you can’t afford to! You can appeal or ask for reconsideration of a decision by a single member of the MRC. You can also appeal that decision to the Health Professions Appeal and Review Board. Since the new MRC regime came into force, we know of no doctor who has appealed an MRC decision before a judge in a court of law. Why?

It is because of the recent implementation by the MOHTLC and General Manager of OHIP of section 27.2(2) of the Health Insurance Act which allows the General Manager to collect money owing by a physician plus retroactive interest and the costs of the MRC for reviewing the member’s practice as soon as a repayment Direction is issued by the MRC. This is done without waiting for any reconsideration or appeal, even while the physician has appeal rights available! If the physician does not pay the monies owing, then the General Manager will simply deduct it from the physician's OHIP remittances. If this is not enough, then physician’s assets can be seized (eg RRSPs).

Any physician who wishes to appeal an MRC decision is faced with the impossible task of continuing to manage a practice, pay overhead, pay personal expenses, and pay legal fees in connection with the appeal, all at the same time AND pay the full amount of the Direction within 1 year. This could result in total financial ruin, and may well make appealing the decision virtually impossible.

We believe that the Government's implementation of this process is an act of profound bad faith, designed to prevent physicians from appealing decisions of the MRC. It shows distrust by the government for doctors at a time when the government is asking us to show faith and trust in them.

We absolutely disagree with this affront on individual freedom.

This process is destroying honest, hardworking physicians while health care itself withers for lack of resources. This state of affairs occurs in no other legal proceeding. It has to stop. NOW!

What we are doing for you #1:

Following a meeting with Legal Counsel, the Coalition has decided to provide financial assistance to a family physician (and COFP member) in the appeal of his MRC decision. Following an MRC review, this physician was ordered to repay the General Manager of OHIP for services rendered to his patients despite that there is no dispute that he rendered every service for which he billed OHIP. (The case is now at the Reconsideration phase and cannot be appealed to the Appeal Board or the Courts until the Reconsideration is complete). This will be a test case and hopefully will be a precedent setting victory for all honest, hard working doctors (specialists included). We applaud the integrity of this family physician and others who are not prepared to accept unfair decisions resulting from an unfair process.

What we are doing for you #2:

The Coalition will be submitting a motion to OMA Council to obtain the OMA’s support in our lobby of the Minister towards this goal. Please ensure that your OMA Representative knows where you stand on the issue!

How does this apply to Family Health Network (FHN) contracts?

 

We appreciate the trust and respect you give us for our critical opinions on a number of issues that we have faced together over the years. We are equally critical of the legal language in the FHN contracts. We hope that you are aware of our concerns by now. Be aware that we believe that equally odious MOHLTC interpretations of the FHN contracts await us.

Would we trust a Government that acts in such bad faith in the MRC process not to? NO!

We therefore advise that no physician should sign any contract with Government Agencies, including OFHN, until the Government shows the same good faith they seek from us by directing the Manager of OHIP to cease garnishing physician remittances following MRC proceedings before a fair and just appeal process has occurred.

What you can do for your fellow family physician #1:

We are also forming a panel of expert witnesses who will testify only on behalf of, and not against, physicians in MRC proceedings. For the purposes of MRC proceedings against family physicians, anyone who practices family medicine in Ontario could serve as an expert witness. Please help with your support both professionally and financially by putting your name forward as an expert witness and donating a little of your valuable time to help family physicians in MRC appeals. We would also ask that you graciously decline any request to be an expert witness against your fellow physicians if invited to do so by the MOHLTC while the MRC process remains grossly unfair and unjust to the physicians of Ontario.

What you can do for your fellow family physician #2:

In addition to providing direct assistance to one physician in his appeal, the COFP will be establishing an MRC Appeal Fund to help other members with meritorious cases. Stay tuned.
